ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING [THERE IS NO CHANGE IN THE JUDGMENT]

THE COURT:

It is ordered that the opinion filed herein on May 9, 2007, be modified as follows:

On page 6, in the fourth full paragraph, the words “without permission of the court” are deleted from the sentence that presently reads, “On that date, Hufnagel, in propria persona, also filed a cross-complaint without permission of the court.”

On page 6, in the seventh full paragraph, the words “nor did they file a substitution of attorney form” is deleted from the sentence that presently reads, “However, thereafter neither Hufnagel nor attorney Dailey filed an opposition to the motion, nor did they file a substitution of attorney form.”

The petition for rehearing is denied.

There is no change in the judgment.
