CRAIG JUBY, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 427th District Court Travis County, Texas
Trial Court Cause Nos. D-1-DC-16-100359 , D-1-DC-16-100360, D-1-DC-16-100361, D-1-DC-16-100362, D-1-DC-16-100363, D-1-DC-16-301894, and D-1-DC-16-301895

ABATEMENT ORDER

Appellant was convicted of aggravated assault against a public servant in the following five cause numbers: D-1-DC-16-100359 (Appeal No. 14-18-00374-CR), D-1-DC-16-100360 (Appeal No. 14-18-00375-CR), D-1-DC-16-100361 (Appeal No. 14-18-00376-CR), D-1-DC-16-100362 (Appeal No. 14-18-00377-CR), and D-1-DC-16-100363 (Appeal No. 14-18-00378-CR). In the same criminal proceeding, appellant was also convicted of aggravated assault-family violence in the following two cause numbers: D-1-DC-16-301894 (Appeal No. 14-18-00379-CR) and D-1-DC-16-301895 (Appeal No. 14-18-00380-CR).

Appellant's appointed counsel, Michael Chandler, filed a single brief on appeal, which challenged the convictions for aggravated assault against a public servant. Chandler did not raise any issues challenging the convictions for aggravated assault-family violence.

Because Chandler has not raised any issues challenging the convictions for aggravated assault-family violence, or otherwise followed the procedures set forth in Anders v. California, 386 U.S. 738, 742-44 (1967), Chandler has deprived appellant of effective assistance of counsel.

To provide appellant with effective assistance of counsel on appeal, we ORDER Chandler to file an amended brief in compliance with the appellate rules and, if necessary, Anders. The amended brief is due in this court by July 25 , 2019 .

The appeals are ABATED, treated as closed cases, and removed from this court's active docket. The appeals will be reinstated on this court's docket after the amended brief is filed. The court will also consider an appropriate motion to reinstate the appeals filed by either party, or the court may reinstate the appeals on its own motion.

PER CURIAM Panel consists of Justices Christopher, Bourliot, and Zimmerer.
