Present — Townley, Untermyer, Dore, Cohn and Callahan, JJ.


After considering the record on appeal, including the complaint as pleaded in Andie v. Kaplan ( 288 N.Y. 685), we are constrained to affirm this order. Order, so far as appealed from, unanimously affirmed, with twenty dollars costs and disbursements, with leave to the defendant-respondent to answer within ten days after entry of order.
