Judgment reversed upon the law and the facts and a new trial granted, costs to appellant to abide the event. The complaint was dismissed before plaintiff rested and before an opportunity was given to him to present his case. Lazansky, P.J., Rich, Kapper, Seeger and Scudder, JJ., concur.
