ORDER


On December 6, 2005, petitioner's request for a stay of proceedings on claim four of his habeas corpus petition, in which petitioner asserts that his sentence violates Blakely v. Washington, 542 U.S. 296 (2004), and United States v. Booker, 543 U.S. 220 (2005), was granted. Doc. No. 21. The remainder of petitioner's claims were dismissed. Petitioner was directed to advise the Court every ninety days regarding the status of state court proceedings. Doc. No. 21. He has failed to do so.

Petitioner is DIRECTED to advise the Court of the status of state court proceedings within ten (10) days of the date of this order. Failure to do so may result in dismissal of this action.

IT IS SO ORDERED.
