THE COURT:

It is ordered that the opinion filed herein on March 28, 2007, be modified as follows:

In footnote 3, beginning on page 9 of the opinion and ending on page 10 of the opinion, the final sentence, which reads, “(DeGrace v. Haring (Sept. 23, 2004, C045182) [nonpub. opn.].)” shall be deleted.

There is no change in the judgment.
