Appellant having moved for permission to proceed as a poor person, assignment of counsel and relief pursuant to CPLR 5520 (c) on an appeal from a judgment of the Court of Claims entered in the Office of the Clerk of said court on October 23, 2013,

Now, upon reading and filing the affidavit of Clemon Jones sworn to August 5, 2014, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed on the ground that the appeal was previously dismissed pursuant to this Court's rules (see 22 NYCRR 1000.12 [b]).
