Order

By order of December 22, 2021, the application for leave to appeal the April 1, 2021 judgment of the Court of Appeals was held in abeyance pending the decision in Elia Cos, LLC v Univ of Mich Regents ). On order of the Court, the case having been decided on May 2, 2023, 511 Mich. 66, 993 N.W.2d 392(2023), the application is again considered. Pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we VACATE the judgment of the Court of Appeals and REMAND this case to that court for reconsideration in light of Elia Cos and, if necessary, for consideration of the issues raised by the plaintiff but not addressed by the court during its initial review of this case.

We do not retain jurisdiction.
