          ORDER ADOPTING FINDINGS, CONCLUSIONS AND RECOMMENDATIONS OF UNITED STATES MAGISTRATE JUDGE

          JOHN F. WALTER, District Judge.

         Pursuant to 28 U.S.C. section 636, the Court has reviewed the Complaint, all of the records herein and the attached Report and Recommendation of United States Magistrate Judge. The Court approves and adopts the Magistrate Judge's Report and Recommendation.

         IT IS ORDERED that: (1) Defendant's Motion for Summary Judgment is granted; (2) Plaintiff's Motion for Summary Judgment is denied as moot; (3) Judgment shall be entered in favor of Defendant City of Los Angeles; and (4) the action is dismissed without prejudice as against the fictitious "Doe" Defendants.

         IT IS FURTHER ORDERED that the Clerk serve forthwith a copy of this Order and the Judgment of this date on Plaintiff and counsel for Defendants.
