PLAINTIFFS NOTICE OF VOLUNTARY DISMISSAL WITHOUT PREJUDICE


Plaintiff R. Brent Johnson hereby files this Notice of Voluntary Dismissal Without Prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1)(i). Plaintiff filed his Original Complaint against the Defendants on June 1, 2001; his First Amended Complaint on May 28, 2002; and his Second Amended Complaint on August 30, 2002. Defendants have been served with all of the complaints. Defendants have not served an answer or a motion for summary judgment. Plaintiff files this Notice of Dismissal under Rule 41(a)(1)(i) with the intention of dismissing this action without prejudice to refiling.
