Johnson v. Thomas

Appellate Division of the Supreme Court of New York, Fourth Department
Mar 5, 1947
271 App. Div. 1049 (N.Y. App. Div. 1947)

Opinion

March 5, 1947.

Present — Taylor, P.J., Dowling, Harris, McCurn and Larkin, JJ.

Judgment and order reversed on the facts and a new trial granted, with costs to the appellant to abide the event, on the ground that the verdict is against the weight of evidence. All concur, except Harris, J., who dissents and votes for affirmance. (The judgment is for plaintiff in an automobile negligence action. The order denies a motion for a new trial.)
