We REINSTATE this appeal.
On June 7, 2023, this Court abated this appeal and ordered the trial court to conduct a hearing and make written findings and recommendations concerning the failure of appellant's counsel, April Smith, to file the brief. The trial court's written findings and recommendations were due to be transmitted to this Court thirty days after June 7, 2023, which was July 7, 2023. As of the date of this order, appellant's brief has not been filed, and this Court has not received the trial court's written findings. This Court's order of June 7, 2023 remains in effect.
We ORDER the trial court to comply with this Court's order of June 7, 2023 and transmit a record of the proceedings, which shall include written findings and recommendations, to this Court within FIFTEEN DAYS of the date of this order.
We DIRECT the Clerk to send copies of this order to the Honorable Carter Thompson, Presiding Judge, Criminal District Court No. 5, Dallas County; and counsel for all parties.
We ABATE this appeal to allow the trial court to comply with this order. This appeal will be reinstated when the Court receives the trial court's findings or at such time as the Court deems appropriate.
