AND NOW, this 8th day of September, 2004, upon consideration of the Motion by Third Party Defendant First Choice Builders, Inc. to Strike the Third-Party Complaint of Mortgage Electronic Registration Systems, Inc. (as nominee of Household Mortgage Services) Against First Choice Builders, Inc. for Failure to State a Claim Upon Which Relief Can Be Granted, the Response of Household Mortgage Services and the Reply briefs by both parties, it is hereby ORDERED that the Motion is DENIED.

It is so ORDERED.
