Opinion

No. 05-10-00354-CV

Opinion issued May 5, 2010.

On Appeal from the County Court at Law No. 1, Dallas County, Texas, Trial Court Cause No. CC-10-00093.

Before Chief Justice WRIGHT and Justices O'NEILL and MYERS.

MEMORANDUM OPINION

By letter dated March 23, 2010, the Court directed appellant to pay the $175 filing fee for the appeal within ten days. We warned that failure to pay the filing fee would result in dismissal of the appeal. See Tex. R. App. P. 42.3. To date, appellant has neither paid the filing fee nor otherwise communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal.

The notice of appeal is captioned GMAC Mortgage LLC as Servicing Agent[,] Plaintiff v. Gregory Hartwell and/or All Occupant[s] of 7839 Kansas Ave.[,] Dallas[,] TX 75241[,] Defendant. However the only individual who filed a notice of appeal is Gregory Johnson, who identified himself as "tenant" in the notice of appeal.
