Case No. 3:13cv00301

02-24-2015

BRENDA JOHNSON, Plaintiff, v. CAROLYN W. COLVIN, Commissioner of the Social Security Administration, Defendant.

District Judge Thomas M. Rose

REPORT AND RECOMMENDATIONS

Attached hereto is a NOTICE to the parties regarding objections to this Report and Recommendations.

This case is before the Court upon Plaintiff's Motion For Attorney Fees Under The Equal Access To Justice Act, 28 U.S.C. §2412(d). (Doc. #18). The Commissioner has not filed a Memorandum in Opposition or otherwise opposed Plaintiff's Motion.

Plaintiff's Motion seeks an award of attorney fees under the Equal Access To Justice Act in the amount of $5,676.66 for attorney work performed in this case and in this Court. In the absence of opposition by the Commissioner, Plaintiff's Motion, Memorandum, and supporting documents establish that an award of attorney fees is warranted under 28 U.S.C. §2412(d) in the amount the Motion seeks.

Accordingly, the Court hereby RECOMMENDS that:

1. Plaintiff's Motion For Attorney Fees Under The Equal Access To Justice Act, 28 U.S.C. §2412(d) (Doc. #18) be GRANTED;

2. The Commissioner be directed to pay Plaintiff's attorney fees in the total amount of $5,676.66; and

3. The case remain terminated on the docket of this Court.
