Originally appealed to the Third Court of Appeals, this appeal was transferred to this Court by the Texas Supreme Court pursuant to its docket equalization efforts. TEX. GOV'T CODE ANN. § 73.001.

On March 5, 2024, appellant Paul Johnson filed a motion with this Court seeking nonsuit of his appeal without prejudice. This Court previously issued our memorandum opinion affirming the trial court's judgment on September 29, 2023. Johnson filed a motion for rehearing, which we denied on October 25, 2023. We lost plenary power over this appeal 30 days after denying Johnson's motion, or November 27, 2023. See TEX. R. APP. P. 19.1(b). Consequently, we are without power to rule on Johnson's motion. We dismiss Johnson's motion for want of jurisdiction.
