DISMISSAL OF ACTION WITHOUT PREJUDICE
Plaintiff has not responded in any way to this Court's Order to Show Cause re Failure to Appear at Case Management Conference and Failure to Serve Summons and Complaint, filed December 18, 2002, nor has plaintiff filed proof that defendant has been served with summons and complaint.
Accordingly, this action is DISMISSED without prejudice, in accordance with Rule 4(m) of the Federal Rules of Civil Procedure.
