Jensen v. Casey

District Court of Appeal of Florida, Second District.
Oct 15, 2013
146 So. 3d 34 (Fla. Dist. Ct. App. 2013)

Opinion

No. 2D13–3815.

10-15-2013

Peggy Ann JENSEN, Appellant/Petitioner(s), v. Marie CASEY, Appellee/Respondent(s).

Opinion

BY ORDER OF THE COURT.

The appellees' motion to determine finality of order on appeal and cross-appeal is granted. This appeal and the cross-appeal are dismissed as challenging a nonfinal nonappealable order. Cf. Elder Care Health Services, LLC, v. Losasso, 810 So.2d 994 (Fla. 4th DCA 2002) (concerning piecemeal appeals challenging fee orders); see also Mcllveen v. Mcllveen, 644 So.2d 612 (Fla. 2d DCA 1994) (orders merely determining entitlement to fees not appealable). Our dismissal is without prejudice to the parties to obtain a final appealable order from the trial court.

SILBERMAN, LaROSE, and SLEET, JJ., Concur.
