This matter came before the Court on January 15, 2009 for a telephonic status conference. As set forth more fully on the record, the Court approved a modification to the Class Definition and Class Notice to include an end date of March 24, 2008. Further, the parties agreed to the following schedule with respect to the outstanding issues related to Class Notification, as set forth in the Notice of Updated Case Status (Doc. 135):
Plaintiffs are directed to file a copy of the revised Class Notice no later than February 13, 2009.
By January 30, 2009 The parties will confer, and divide in half the files of those individuals who have been identified as consumers whose deficiency balances have been discharged in bankruptcy and confirm such discharges by researching the dockets of the two United States Bankruptcy Courts in the State of Ohio; Defendant will produce documents or other information that will identify and confirm the consumers against whom it has obtained a deficiency judgment; Defendant will produce documents or other information identifying the consumers in the State of Ohio whose vehicles were repossessed and subsequently disposed of by Defendant in the period between July 1, 2007 and March 24, 2008. February 13, 2009 Plaintiff shall send the revised Class Notice via first class mail, postage pre-paid, to all the identified putative class members. IT IS SO ORDERED.
