On August 3, 2023, this Court directed appellant by letter to provide notice in ten days that he had requested preparation of the reporter's record and written verification that he had paid or made arrangements to pay the court reporters' fee or written documentation that he has been found to be entitled to proceed without payment of costs. On August 16, 2023, appellant filed a letter stating, "This letter serves to notify the court that payment arrangements are being made with Trisha Phillips, CSR. . . . Please permit additional time for payments to the CSR so that the transcript may be included in the brief." On September 11, 2023, this Court ordered appellant to file within ten days written verification that he had paid or made arrangements to pay the court reporters' fee. We cautioned appellant that if we did not receive the required documentation within the stated time, the Court might order the appeal submitted without the reporter's record. As of the date of this order, the reporter's record has not been filed, and appellant has not presented written verification that he has paid for the reporter's record, nor has he filed any response to this Court's order of September 11, 2023.
Accordingly, we ORDER this appeal submitted without the reporter's record. Tex.R.App.P. 37.3(a) (2), (c)(2). Appellant's brief is due NOVEMBER 9, 2023.
We DIRECT the Clerk to send copies of this order to Trisha L. Phillips, Official Court Reporter for County Criminal Court No. 10, Dallas County; appellant Ansel Eugene Jeffries; and the Dallas County District Attorney's Office, Appellate Division.
