MAURICE LASALLE JEFFERSON, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 283rd Judicial District Court Dallas County, Texas
Trial Court Cause Nos. F15-30471-T, F14-31181-T

ORDER

The Court REINSTATES the appeals.

On December 21, 2015, we ordered the trial court to make findings regarding why appellant's brief had not been filed. On December 31, 2015, we received appellant's brief, together with an extension motion. Therefore, in the interest of expediting the appeals, we VACATE the December 21, 2015 order requiring findings.

We ORDER appellant's brief filed as of the date of this order.

The Court has before it appellant's motion to supplement the record with copies of the punishment jury charge that are signed by the judge who presided over the trial. The copy of the punishment charge in the clerk's record for cause no. 05-15-00962-CR is signed by the judge; the copy in the clerk's record for cause no. 05-15-00961-CR (trial court no. F15-30471-T) is not signed by the judge. We also note that neither record contains the trial court's certification of appellant's right to appeal.

Accordingly, we ORDER the trial court to prepare and file with the Dallas County District Clerk, within TEN DAYS of the date of this order, certifications of appellant's right to appeal that accurately reflect the trial court proceedings. See TEX. R. APP. P. 25.2(a), (d); Cortez v. State, 420 S.W.3d 803 (Tex. Crim. App. 2013).

We ORDER the Dallas County District Clerk to file, within TWENTY DAYS of the date of this order, supplemental clerk's records that contain the trial court's certifications of appellant's right to appeal and copies of the punishment jury charge that are signed by the trial court judge.

We DIRECT the Clerk to send copies of this order to the Honorable Rick Magnis, Presiding Judge, 283rd Judicial District Court; Felicia Pitre, Dallas County District Clerk; and to counsel for all parties.
