Before the Court is the October 17, 2023 motion of appellant Lamar "Yaka" Jefferson for an extension of time to file his opening brief. Because the reporter's record has not been filed, appellant's brief is not yet due. See Tex. R. App. P. 38.6(a)(2). Accordingly, we DENY the motion as premature.

By post-card notice dated October 9, 2023, the Court notified the court reporter that the reporter's record is overdue and directed her to file the record within ten days.

We DIRECT the Clerk of this Court to send a copy of this order to Official Court Reporter Terri Etekochay and all parties.
