Opinion

Gen. No. 43,462. (Abstract of Decisions.)

Opinion filed. January 7, 1946 Released for publication January 21, 1946

AUTOMOBILES AND MOTOR VEHICLES, § 167.2denial of motion to strike irresponsive answers of witness as reversible error. On appeal from judgment entered in favor of defendants in action to recover for personal injuries allegedly caused when plaintiff was struck by defendants' truck while crossing street after alighting from street car, where plaintiff contended that misleading evidence was improperly allowed to go to jury, and it appeared that witness, on examination and cross examination, made several irresponsive answers which were admitted, held that denial of motions to strike such answers constituted reversible error.
