[PROPOSED] ORDER AWARDING ATTORNEY'S FEES UNDER 42 U.S.C. § 406(b)

HON. MARIA A. AUDERO, UNITED STATES MAGISTRATE JUDGE.

Having reviewed and considered plaintiff's counsel's Motion for Authorization of Attorney Fees Under 42 U.S.C. § 406(b), all supporting declarations and documentation, and any and all subsequent briefing, IT IS ORDERED that plaintiff's counsel's request for attorneys' fees under 42 U.S.C. § 406(b) is GRANTED. Section 406(b) fees are allowed in the amount of ELEVEN THOUSAND FIVE HUNDRED FIFTY TWO DOLLARS AND 26/100 ($11,552.26), to plaintiff's counsel ROGER DRAKE.

Out of this gross fee plaintiff's counsel W ll refund to plainf EAJA fees previously awarded in the amount of $4,000. .
