James v. Universal Motown Records, Inc.

United States District Court, S.D. New York
Feb 10, 2005
No. 03 Civ. 4487 (LAK) (S.D.N.Y. Feb. 10, 2005)

Opinion

No. 03 Civ. 4487 (LAK).

February 10, 2005

ORDER

Plaintiffs move for leave to amend the complaint as against defendant Jelly's Jams, LLC. No opposing papers have been filed. Accordingly, without considering the legal sufficiency of the proposed amended complaint, the motion is granted and deemed served this day. The time of defendant Jelly's Jams, LLC to answer or move with respect to the complaint therefore is twenty days from today.

Plaintiffs' motion papers also seek a ruling that the amended complaint "relates back" for statute of limitations purposes. That issue is not presented on the motion for leave to amend. The Court expresses no opinion on it.

SO ORDERED.
