DECISION & ORDER ON APPLICATION

Appeal from an order of the Supreme Court, Queens County, entered May 20, 2015. Application by Claudette James, as executor of the estate of Effingham James, to be substituted for the deceased appellant, Effingham James, to amend the caption accordingly, and to withdraw the appeal.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, and upon the stipulation dated February 23, 2021, it is

ORDERED that the application is granted, Claudette James, as executor of the estate of Effingham James, is substituted for the deceased appellant, Effingham James, the caption is amended accordingly, and the appeal is deemed withdrawn, without costs or disbursements.
