          ORDER OF DISMISSAL

          CHARLES BREYER, District Judge.

         On May 14, 2004, the Court issued an order for plaintiff to show cause by May 27, 2004 as to why this Federal Tort Claim Act action should not be dismissed as untimely. As of this date plaintiff has not responded. Accordingly, as plaintiff's complaint and the papers attached to his complaint demonstrate that is claim is time barred, this action is hereby DISMISSED with prejudice.

         IT IS SO ORDERED.

         JUDGMENT

         The Court having dismissed plaintiff's complaint with prejudice by Order dated May 28, 2004, it is hereby ordered that judgment be entered in favor of defendant and against plaintiff.

         IT IS SO ORDERED.
