Opinion

Robert J. Jaffe, M.D v. John G. Roberts, et al No. CV 15-1018 DSF United States District Court, C.D. California July 28, 2015

          MEMORANDUM

DALE S. FISCHER, United States District Judge.

PROCEEDINGS: (IN CHAMBERS) ORDER GRANTING MOTION TO DISMISS (DKT. NO. 21)

The Court deems this matter appropriate for decision without oral argument. See Fed.R.Civ.P. 78; Local Rule 7-15. The hearing set for August 3, 2015 is removed from the Court's calendar.

Defendants -- the nine members of the United States Supreme Court -- move to dismiss the complaint against them. The complaint alleges that the Supreme Court was incorrect in its refusal to grant a writ of certiorari in Plaintiff's state court case, and Plaintiff requests that this Court reopen the matter to consider his allegations of " fraud on the court." As Defendants argue, this Court has no jurisdiction to review the actions of the Supreme Court nor any authority to correct any perceived errors made by that court.

The motion to dismiss is GRANTED.

         IT IS SO ORDERED.

         JUDGMENT

The Court having ordered that the case be dismissed, IT IS ORDERED AND ADJUDGED that the plaintiff take nothing, that the action be dismissed with prejudice, and that defendants recover their costs of suit pursuant to a bill of costs filed in accordance with 28 U.S.C. § 1919.
