Jackson v. State

District Court of Appeal of Florida, First District
Aug 1, 1994
641 So. 2d 925 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-1995.

August 1, 1994.

An appeal from the Circuit Court for Bay County; Don T. Sirmons, Judge.

Nancy A. Daniels, Public Defender, P. Douglas Brinkmeyer, Asst. Public Defender, Tallahassee, for appellant.

James B. Jackson, pro se.

Robert A. Butterworth, Atty. Gen., Marilyn McFadden, Asst. Atty. Gen., Tallahassee, for appellee.

Appellant's sentence is reversed, because the trial court erroneously used a new sentencing guideline scoresheet, rather than the original scoresheet, after sentencing appellant following the revocation of his community control. The case is remanded for resentencing under the original scoresheet. Pfeiffer v. State, 568 So.2d 530 (Fla. 1st DCA 1990); Manuel v. State, 582 So.2d 823 (Fla. 2d DCA 1991).

REVERSED and REMANDED for further proceedings.

WOLF and KAHN, JJ., concur.
