Matthew Jamal JACKSON, Appellant v. The STATE of Texas, Appellee

From the 379th Judicial District Court, Bexar County, Texas
Trial Court No. 2014CR0148
Honorable Ron Rangel, Judge Presiding

ORDER

Sitting: Sandee Bryan Marion, Chief Justice Patricia O. Alvarez, Justice Luz Elena D. Chapa, Justice

On July 6, 2016, we issued a memorandum opinion and judgment in this case affirming appellant's conviction. On July 18, 2016, we denied appellant's motions for rehearing and en banc reconsideration. Appellant thereafter filed a petition for discretionary review with the Court of Criminal Appeals. On November 18, 2016, appellant filed a pro se motion in this court seeking further relief from this court. Our authority to issue orders in an appeal expires "30 days after the court overrules all timely filed motions for rehearing or en banc reconsideration, and all timely filed motions to extend time to file such a motion." See TEX. R. APP. P. 19.1(b); see also Vidales v. State, 471 S.W.3d 457, 458 (Tex. Crim. App. 2015) (per curiam) (holding court of appeals may not issue an opinion after a petition for discretionary review has been filed with the Court of Criminal Appeals). Appellant's pro se motion is denied.

Luz Elena D. Chapa, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 22nd day of November, 2016.
