Opinion

No. 3D11–3173.

2012-07-23

Alberic ISRAEL and Sheila Mesdieu, Appellant(s)/Petitioner(s), v. CIRCUIT COURT OF THE 11TH JUDICIAL CIRCUIT, 10–7915, Appellee(s)/Respondent(s).

Alberic Israel petitions this Court for a writ of mandamus, seeking an order to compel the trial court to issue judgment in a pending civil lawsuit. Following review of the petition for writ of mandamus, it is ordered that said petition is dismissed on the grounds that the petitioner previously filed the identical petition in this Court, case number 3D11–10, which this Court dismissed for failure to follow the Florida Rules of Civil Procedure in the circuit court. This petition suffers from the same procedural infirmity.

SALTER, EMAS, and FERNANDEZ, JJ., concur.
