ORDER


Upon consideration of the motion to remand the case to the district court, the opposition thereto, and the reply; the lodged motion for summary reversal (styled "motion to vacate"); the motion to disqualify attorney Robert E. Grant (appellee's counsel) and for sanctions (styled "objection to entry of appearance by Grant"); the motion to recuse the district court judge; and the motion for extension of time to file any dispositive motion or appellant's opening brief until 10 days after an order on the motion to remand has been entered, it is

ORDERED that the motion for extension of time to file any dispositive motion be granted. The Clerk is directed to file the lodged motion for summary reversal. It is

FURTHER ORDERED that the motions for summary reversal and to remand be denied. The merits of the parties' positions are not so clear as to warrant summary action. See Taxpayers Watchdog, Inc. v. Stanley, 819 F.2d 294, 297 (D.C. Cir. 1987) (per curiam). It is

FURTHER ORDERED that the motion to disqualify Robert E. Grant and for sanctions be denied. Appellant provides no grounds for disqualification or for sanctions. It is

FURTHER ORDERED that the motion to recuse the district court judge be denied. See Liteky v. United States, 510 U.S. 540, 555 (1994) ("[J]udicial remarks during the course of a trial that are critical or disapproving of, or even hostile to, counsel, the parties, or their cases, ordinarily do not support a bias or partiality challenge.").
