JAMES V. IOVINO, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Elizabeth Crewson Paris Judge

On March 8, 2024, docket entry 18, respondent filed a Status Report which indicates that petitioner Diane Iovino informed respondent's counsel that petitioner, James V. Iovino, had passed away on December 25, 2023. Respondent attempted to contact Ms. Iovino at both phone numbers that she provided, but was unable to contact her or leave a voice message. In addition, respondent mailed Ms. Iovino a letter to schedule a conference call with her. Respondent's Status Report indicates that an internal IDRS transcript reflects that James V. Iovino was deceased, as of December 25, 2023, and has attached as Exhibit A a copy of an INOLES transcript for petitioner thereto.

After due consideration, it is

ORDERED that the caption of this case is amended to read: "James V. Iovino, Deceased, Petitioner v. Commissioner of Internal Revenue, Respondent." It is further

ORDERED that, on or before May 13, 2024, respondent shall file a Status Report with the Court that shall include: (1) whether there are any heirs-at-law of the decedent other than petitioner Diane Iovino; (2) and, if so, the names and addresses of those heirs- at- law; and (3) a copy of the decedent's death certificate.
