ORDER GRANTING JOINT MOTION FOR DISMISSAL WITHOUT PREJUDICE


On October 10, 2007, Plaintiff Invitrogen Corporation ("Invitrogen") and Defendant President and Fellows of Harvard College ("Harvard") filed the pending Joint Motion for Dismissal Without Prejudice. (Doc. # 27.)

Good cause appearing, the Joint Motion is GRANTED. (Doc. # 27.) IT IS HEREBY ORDERED that the above-captioned matter is dismissed without prejudice pursuant to Fed.R.Civ.P. 41(a), with each party to bear its own fees and costs, and that the parties will proceed to litigate the matter on the merits in the United States District Court for the District of Massachusetts sub nom Invitrogen Corporation v. President and Fellows of Harvard College, Civil Action No. 07-cv-10917-NMG.

IT IS SO ORDERED.
