ORDER ON PENDING MOTIONS


The court GRANTS IN PART AND DENIES IN PART Interwest Tranfer's Motion for Summary Judgment (#283-1). The court GRANTS Interwest's motion for Summary Judgment on the claim for Civil Conspiracy, Declaratory Judgment, and Injunctive Relief. The court DENIES Interwest's Motion for Summary Judgment on a Conversion, Wrongful Failure to Transfer, and Mark Wiltshire's claims. The court DENIES the Stockbroker's Motion for Partial Summary Judgment (#289-1).

The court GRANTS the Motion to Strike the affidavit of Barkley Clark (#310-1). The court GRANTS the Motion in Limine to exclude the testimony of Barkley Clark (#310-2). The court GRANTS the Motion to Strike the affidavit of Robert Appel (#301-1). The court GRANTS the Motion in Limine to Exclude the testimony of Robert Appel (#301-2). The parties may file redacted, admissible versions of Mssrs. Appel and Clark's reports by June 4, 2004.

The court DENIES the Motion to Strike Exhibit B (#308-1). The court DENIES the motion to exclude the testimony of David Nelson as Moot, for purposes of this motion only (#312-1). The court GRANTS IN PART and DENIES IN PART the Motion to Strike Portions of Expert Reports (#296-1).

SO ORDERED.
