To both correct the record and to allow the parties an opportunity to address the facts and law at issue in the Commissioner's Motion, it is
ORDERED that the Clerk shall recharacterize the Commissioner's Motion for Summary Judgment as a Motion for Partial Summary Judgment. It is further
ORDERED that by January 5, 2024, petitioner shall file a response to the Commissioner's Motion for Partial Summary Judgment. It is further
ORDERED that by January 19, 2024, the Commissioner may file a reply to petitioner's response.
