Inloes v. State

District Court of Appeal of Florida, Fourth District
Sep 22, 1993
625 So. 2d 81 (Fla. Dist. Ct. App. 1993)

Opinion

No. 92-0884.

September 22, 1993.

Appeal from the Circuit Court for Broward County; Charles M. Greene, Judge.

Richard L. Jorandby, Public Defender, and Susan D. Cline, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Dawn S. Wynn, Asst. Atty. Gen., West Palm Beach, for appellee.

We reverse and remand for a new trial on the authority of Lewis v. State, 623 So.2d 1205 (Fla. 4th DCA 1993).

Although we are reversing because the trial court erroneously gave an instruction on flight, we find no error in the other issues raised by appellant, and we conclude the sentencing issue raised is rendered moot by our decision.

ANSTEAD, HERSEY and GLICKSTEIN, JJ., concur.
