Case No. 17-00595 BLF (PR)
11-07-2018
JOHN A. INDIVERI, Plaintiff, v. RICHARD MACK, et al., Defendants.
ORDER GRANTING IN PART DEFENDANTS' MOTION FOR EXTENSION OF TIME TO FILE OPPOSITION TO PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT; GRANTING EXTENSION OF TIME TO FILE SUMMARY JUDGMENT MOTION
(Docket No. 63)
Plaintiff, a California state prisoner, proceeding pro se, filed a civil rights complaint pursuant to 42 U.S.C. § 1983 against medical personnel at the Salinas Valley State Prison ("SVSP") and the medical appeals office. Defendants filed a motion for an extension of time to file an opposition to Plaintiff's motion for summary judgment and a summary judgment motion to January 7, 2019. (Docket No. 63.) Although the Court previously granted Defendants' motion to file a combination opposition to Plaintiff's motion and a cross-summary judgment motion, (Docket No. 54), this request for additional time renders Plaintiff's summary judgment motion pending for nearly nine months. Accordingly, the Court directs Defendants to file an opposition to Plaintiff's summary judgement motion expeditiously, and file their summary judgment at a later time.
Defendants' opposition to Plaintiff's summary judgment motion shall be filed no later than December 20, 2018, which is an extension of thirty-five days from the original deadline of November 8, 2018. Plaintiff's reply shall be filed no later than fourteen (14) days from the date Defendants' opposition is filed.
For good cause shown, Defendants' motion for an extension of time to file a summary judgment motion is GRANTED. Defendants' summary judgment motion shall be filed no later than January 7, 2019. Plaintiff's opposition shall be filed no later than twenty-eight (28) days from the date Defendants' summary judgment motion is filed. Defendants' reply shall be filed no later than fourteen (14) days from the date Plaintiff's opposition is filed.
This order terminates Docket No. 63.
IT IS SO ORDERED. Dated: 11 /07 /2018
