Decisions Pursuant to Rule 1:28. As to count 1 of the plaintiff's amended verified complaint, the judgment is vacated. not on the merits but as moot, and the cross appeal thereon is dismissed. The orders denying the defendant's motions to alter or amend judgment and to amend a finding are vacated. As to counts 2 and 3 of the amended verified complaint, the judgments are affirmed.
