Upon consideration of petitioner's Writ of Mandamus, the Commissioner's Michael J. Richardson C.A. No. 00M-10-007 May 14, 2002 recommendation, and the record in this case, it appears:

1. The petitioner filed a Writ of Mandamus on October 14, 2000. The Writ was referred to the Court Commissioner, Andrea Maybee Freud for proposed findings and recommendation pursuant to 10 Del. C. § 512(b) and Superior Court Civil Rule 132.

2. The Commissioner recommended that the Court dismiss the petition as meritless. A copy of her report is attached hereto and no written objections were filed with the Court.

NOW, THEREFORE, after careful and de novo review of the record in this action, and for the reasons stated in the Commissioner's Report and Recommendation dated March 19, 2002,

IT IS ORDERED that:

a. The Commissioner's Report and Recommendation is adopted by the Court;

b. The Petitioner's Motion for Writ of Mandamus is denied.
