In a juvenile delinquency proceeding pursuant to Family Court Act article 3, the appeal is from an order of disposition of the Family Court, Kings County (Bogacz, J.), dated July 30, 1997, which, upon a fact-finding order of the same court, dated March 7, 1997, made after a hearing, finding that the appellant had committed acts which, if committed by an adult, would have constituted the crimes of unlawful imprisonment in the second degree and sexual misconduct, adjudged him to be a juvenile delinquent, and placed him on probation for a period of 18 months. The appeal brings up for review the fact-finding order dated March 7, 1997.

Benjamin C. Rosenberg, Valley Stream, N.Y., for appellant.

Michael A. Cardozo, Corporation Counsel, New York, N.Y. (Edward F.X. Hart and Drake A. Colley of counsel), for respondent.

Before: DAVID S. RITTER, J.P., SANDRA J. FEUERSTEIN, THOMAS A. ADAMS, REINALDO E. RIVERA, JJ.

ORDERED that the order of disposition is affirmed, without costs or disbursements.

Viewing the evidence adduced at the fact-finding hearing in the light most favorable to the Presentment Agency (see Matter of Kerlyn T., 252 A.D.2d 557, 558; cf. People v. Contes, 60 N.Y.2d 620), we find that it was legally sufficient to establish that the appellant committed acts which, if committed by an adult, would have constituted the crimes of unlawful imprisonment in the second degree (see Penal Law § 135.05) and sexual misconduct committed while acting in concert with other persons (see Penal Law § 20.00, 130.20).

RITTER, J.P., FEUERSTEIN, ADAMS and RIVERA, JJ., concur.
