In a proceeding pursuant to Election Law § 16-102 to invalidate a petition designating Joseph Holland as a candidate in a primary election to be held on September 10, 2002, for the nomination of the Republican Party as its candidate for the public office of Member of the United States House of Representatives for the 17th Congressional District, the appeal is from a final order of the Supreme Court, Westchester County (Nicolai, J.), dated August 19, 2002, which, after a hearing, granted the petition and invalidated the designating petition of Joseph Holland.

ORDERED that the final order is affirmed, without costs or disbursements.

The Supreme Court properly granted the petition as the appellant failed to obtain the requisite number of valid signatures.

The appellant's remaining contention is without merit.
