MEMORANDUM OPINION

Original Mandamus Proceeding PER CURIAM Sitting: Sandee Bryan Marion, Chief Justice Patricia O. Alvarez, Justice Jason Pulliam, Justice PETITION FOR WRIT OF MANDAMUS DISMISSED AS MOOT

This proceeding arises out of Cause No. 2006CR5239, styled State v. Juan Guzman Zuniga, pending in the 186th Judicial District Court, Bexar County, Texas, the Honorable Jefferson Moore presiding. --------

Relator filed this petition for writ of mandamus on August 1, 2016, alleging the trial court had failed to rule on two motions: (1) a motion for discovery; and (2) a motion requesting appointment of counsel to assist in obtaining an order for DNA testing. On September 6, 2016, Respondent, the Honorable Jefferson Moore, filed copies of orders denying the two motions, which he signed on August 31, 2016. Therefore, the issue raised by the Relator in this mandamus proceeding has become moot. Accordingly, this original mandamus proceeding is dismissed as moot.
