ORDER


On March 4, 2005, the Court received from counsel for defendant Bernard J. Ebbers ("Ebbers") a proposed order to show cause why claims against Ebbers should not be severed pursuant to Fed.R.Civ.P. 21, as well as a Memorandum of Law in support of Ebbers' motion for severance. It is hereby

ORDERED that counsel for Ebbers must serve and file any severance motion by 5 p.m. on March 7, 2005.

IT IS FURTHER ORDERED that opposition to the motion is due on March 10, 2005. Any reply is due March 14.

Given that defendants Scott Sullivan, David Myers, and Buford Yates, Jr. are situated similarly to Ebbers,

IT IS FURTHER ORDERED that the submissions should address whether the claims against these defendants should not be severed as well.
