ORDER


The parties to the WorldCom consolidated class action trial scheduled to begin on February 28, 2005 have filed motions in limine. To assist them in their preparations for trial, the parties are advised of the following preliminary rulings on those motions. An Opinion describing the motions and rulings will follow in due course. To the extent that the Opinion alters or modifies any of these rulings, that Opinion shall control.

Underwriter Defendants' Motion to Phase the Trial

Denied except for individualized issues pertaining to class members.

Lead Plaintiff's Motions in Limine

No. 2: Denied.

No. 3: Denied, subject to proffer prior to Chafetz testifying.

No. 4: Decision reserved until trial.

No. 5: Denied.

No. 6: Granted.

Underwriter Defendants' Motions in Limine

No. 1: Granted to the extent it seeks to exclude references to the Individual Actions.

No. 2: Granted, subject to a party offering such evidence making a showing of admissibility under Rule 408, Fed.R.Evid.

No. 3: Granted.

No. 4: Granted.

No. 5: Denied to the extent it seeks to exclude evidence of fees paid by WorldCom. Decision reserved on other fees.

No. 6: Granted.

No. 7: Decision reserved in order to allow parties to respond to specific examples given by the Lead Plaintiff in its opposition.

No. 8: Granted in part.
