ORDER


Beginning in December 2004, defendants have filed Phase III and Phase IV motions to dismiss certain Individual Actions. During a telephone conference on June 2, 2005, the Court offered the assistance of the Settlement Judges to supervise settlement discussions in the Individual Actions, and certain counsel urged the Court to refrain from reaching the pending motions while they engaged in a dialogue with their adversaries to determine whether the Individual Actions could be settled. Several months having passed, it is hereby

ORDERED that by September 19, 2005, counsel in any Individual Action in which a motion to dismiss is pending and (1) in which there is no agreement in principle to resolve the Individual Action, or (2) in which the parties are not actively engaged in settlement discussions, shall so advise the Court.

IT IS FURTHER ORDERED that the parties providing such notification will also indicate whether they desire the intervention of the Settlement Judges to initiate and supervise settlement discussions in their Individual Action.
