ORDER


It is hereby ORDERED that the following motions in the class action litigation are denied as moot and shall be closed on the docket:

The February 4, 2005 motion of Arthur Andersen LLP for a continuance of the trial.

The February 4, 2005 motion of the Underwriter Defendants for a continuance of the trial.

IT IS FURTHER ORDERED that the following motion is deemed withdrawn, and, in the event the Directors' Settlement does not become final, may be reinstated by the submission of a letter to the Court:

The December 8, 2004 motion of Bert C. Roberts to reopen discovery for a limited purpose.

IT IS FURTHER ORDERED that the following motion was granted in a conference of February 15, 2005 and shall be closed on the docket: Francesco Galesi's February 3, 2005 motion to advance defense costs.
