Opinion

Master File 02 Civ. 3288 (DLC).

ORDER

On January 20, 2005, in response to this Court's Order of January 17, counsel for Richard Entenmann and Shari Galitzer (the "Entenmann Respondents") submitted a Memorandum opposing the Citigroup Defendants' request for an injunction barring the Entenmann Respondents' arbitration claims. Given that in the Memorandum, counsel indicated that the Entenmann Respondents were opposed to a conference and would be content to rely on their written submission, it is hereby

ORDERED that the January 17 Order To Show Cause is satisfied in regard to the Entenmann Respondents by their submission of the January 20 Memorandum and without attendance of the Entenmann Respondents or their counsel at the conference announced below.

IT IS FURTHER ORDERED that the remaining respondents, Steven D. Roberts, individually and as Trustee for the Wendy Jean Roberts Trust, and Margot B.J. Roberts (the "Roberts Respondents") or their counsel show cause before this Court on January 27, 2005, in Courtroom 11B, 500 Pearl Street, New York, New York, at 2 p.m. why they should not be enjoined from arbitrating their claims against one or more of the Citigroup Defendants, which include Citigroup, Inc., Citgroup Global Markets, Inc. (f/k/a Salomon Smith Barney, Inc.), Citigroup Global Markets Limited (f/k/a Salomon Brothers International Limited), and Jack B. Grubman. This January 27 conference date supersedes the date announced in this Court's January 17 Order.

IT IS FURTHER ORDERED that the briefing schedule announced in the January 17 Order shall remain in place. The Roberts Respondents shall submit any papers in opposition to an injunction by January 24. The Citigroup Defendants shall submit their reply to both the Entenmann Respondents and the Roberts Respondents by January 26.

IT IS FURTHER ORDERED that when filing any papers with the Court, the parties shall provide to chambers two courtesy copies, marked as such, by delivering them to the Courthouse Mailroom, 8th Floor, United States Courthouse, 500 Pearl Street, New York, New York.

IT IS FURTHER ORDERED that counsel for the Citigroup Defendants shall serve this order on all respondents or their counsel by January 22, 2005 by overnight mail or facsimile.

SO ORDERED.
