ORDER


Through an August 29, 2005 Opinion and Order, summary judgment was granted for the defendants in the cases captioned 02 Civ. 2637 (DLC), 03 Civ. 1712 (DLC), 03 Civ. 1713 (DLC), 03 Civ. 1714 (DLC), and 03 Civ. 1715 (DLC). For the reasons set forth in that Opinion, it is hereby

ORDERED that the plaintiffs' motion for class certification in this litigation shall be denied as moot.

IT IS FURTHER ORDERED that the plaintiffs' motions to exclude certain expert testimony of Keith Mallinson and Charles Jackson and the defendants' motions in limine to exclude the testimony and/or opinions of Robert G. Zicker, Gary L. French, Richard Allton, and Douglas Young shall be denied as moot.

IT IS FURTHER ORDERED that the plaintiffs' omnibus motion to strike is denied as moot with the exception of that portion of the motion concerning the declaration of Thomas Bryant, which shall be denied, and that the defendants' motion to exclude the testimony and expert report of Nicholas Economides shall be granted as to Economides's regression analysis and denied as moot with respect to the remainder of the motion.

SO ORDERED.
