ORDER


Having granted summary judgment on August 29, 2005 for the defendants in five actions consolidated in In re Wireless Telephone Services Antitrust Litigation, and the plaintiff in a sixth action, the Freeland Action, 04 Civ. 8653 (DLC), having requested permission to file a separate complaint pursuant to paragraphs 8 and 9 of the August 11, 2003 consolidation order, 2003 WL 21911123, at *2 (S.D.N.Y. Aug. 11, 2003) ("Consolidation Order"), it is hereby

ORDERED that the plaintiff in the Freeland Action may file a separate complaint pursuant to paragraphs 8 and 9 of the Consolidation Order, and his motion for a pretrial schedule is granted.

IT IS FURTHER ORDERED that the defendants' motion to dismiss the Freeland Action as duplicative is denied.

IT IS FURTHER ORDERED that the parties in the Freeland Action shall confer and submit by September 9, 2005 a proposed schedule for that action.

SO ORDERED.
